1. Who we are

SpeaksFluent ("the Service", "we", "us") is operated by Johnny Efrain Ortega("the Seller"). By accessing or using the Service you agree to these Terms.

2. Acceptance

By creating an account, accessing, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. You confirm you are of legal age in your jurisdiction (or have parental consent) to enter into this agreement.

3. The Service

SpeaksFluent is an English learning platform that provides AI tutoring, pronunciation feedback, roleplay scenarios, courses, and related content. Features available to you depend on your plan (Free or Pro).

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for unlawful purposes, fraud, spam, or harassment;
• infringe the intellectual property or privacy rights of others;
• upload malware, attempt to probe, scan, or breach our security;
• scrape, reverse engineer, or attempt to extract source code or models;
• resell or redistribute access to the Service.

5. AI features and user content

The Service uses AI models to generate tutoring responses, pronunciation feedback, and conversational replies. AI outputs may be inaccurate or incomplete and must not be relied on as professional advice. You are responsible for your prompts and how you use outputs, and you must have the rights to any content you submit. We may filter or refuse outputs and remove content that violates these Terms.

6. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account.

7. Intellectual property

The Service, including its software, content, branding, and curriculum, is owned by the Seller and protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable right to use the Service for personal learning within your plan. All other rights are reserved.

8. Payments, billing & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms.

Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time from your Account page; access continues until the end of the paid period.

10. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service and cancel your subscription at any time.

11. Warranties & liability

The Service is provided "as is" without warranties of any kind to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages. Nothing limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Seller's jurisdiction, without regard to conflict-of-law principles.
